The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 17, 2023 SPR23/1877 Teresa Polhemus Executive Director/Secretary Boston Planning & Development Agency 1 City Hall Square, Floor 9 Boston, MA 02201 Dear Ms. Polhemus: I have received the petition of Michael Reiskind appealing the nonresponse of the Boston Planning & Development Agency (Agency) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 28, 2023, Mr. Reiskind requested the following records pertaining to communication between the Agency and the Massachusetts Bay Transportation Authority (MBTA): [1.] Emails, memos, and other documents related to the proposed Arborway bus facility at Forest Hills transmitted between [the Agency] and any MBTA representative between December 1, 2021 and June 12, 2023. Claiming to not yet have received a response, Mr. Reiskind petitioned this office and this appeal, SPR23/1877, was opened as a result. Subsequently, I learned the Agency provided a response to Mr. Reiskind on July 18, 2023. Where this appeal was opened as a result of the Agency’s lack of a written response, I will now consider this administrative appeal closed. Mr. Reiskind may appeal the substantive nature of the Agency’s July 18th response within 90 days. See 950 C.M.R. 32.08(1).
