The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 18, 2023 SPR23/1888 Carol Ann Desiderio City Clerk City of Malden 215 Pleasant Street Malden, MA 02148 Dear Ms. Desiderio: On August 15, 2023, this office received a petition on behalf of the City of Malden (City) seeking an extension of time to produce records, and permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, the City furnished a copy of this petition to the requestor. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On July 31, 2023, Malden News Network requested the following: All email, along with attachments and any metadata, sent to or received from [a specified] email address ... after 6/30/20 to the date of your response to this request. In addition to providing records where [the specified email address] appears anywhere in the TO, CC, or BCC address field, please provide records where [the specified email address] appears in the email content / body during the timeframe indicated. In an email to this office and the City on August 18, 2023, Malden News Network “formally withdraws the underlying records request” relating to the City’s August 15th petition. Conclusion In light of the above, it is unnecessary to opine on the City’s petition for an extension of time to produce records and permission to charge for time spent segregating or redacting responsive records.
