The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records August 21, 2023 SPR23/1894 Austin Simko Assistant Town Manager & Town Clerk Town of Andover 36 Bartlet Street Andover, MA 01810 Dear Mr. Simko: On August 14, 2023, I received your petition on behalf of the Town of Andover (Town) requesting guidance from this office regarding the determination of the effect of a protective order. The Town also requested permission to charge for time spent segregating or redacting responsive records, as well as a waiver of statutory limits on fees that may be assessed in responding to the request. See G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, the Town furnished a copy of this petition to the requestor. G. L. 66, § 10(d)(iv). On August 1, 2023, Michael Meyers requested “electronic copies of all the depositions between the above Defendants [Andover School Committee, Town of Andover] and Wadland & Ackerman representing the above Plaintiff [Fusion Learning, Inc.].” In an email to this office dated August 21, 2023, the Town states, “I would like to withdraw the attached petition submitted on Monday, August 14th.” Conclusion In light of the above, it is unnecessary to opine on the Town’s petition seeking guidance on the effect of a protective order or permission to charge for time spent segregating or redacting responsive records.
