Assistant General Counsel Boston Public Health Commission 1010 Massachusetts Avenue Boston, MA 02118 Dear Attorney Pasternack: I have received the petition of Alba Lara Pena appealing the nonresponse of the Boston Public Health Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 30, 2023, Ms. Lara Pena requested “... a complete copy of any documents (e.g. including but not limited to, computer-Aided dispatch (‘CAD’) sheets, a patient care report (CPR), 911 recording reports, writing notes, diagrams, sketches, videos, photographs, incident reports, emails, memos, etc.) in possession of Boston’s EMS’s office relating to an incident . . . Charlestown, MA on June 26, 2003.” Claiming to not yet have received a response, Ms. Lara Pena petitioned this office and this appeal, SPR23/1936, was opened as a result. Subsequently, I learned that the Commission provided Ms. Lara Pena with a response dated August 28, 2023. Where this appeal was opened as a result of the Commission’s lack of a written response, I will now consider this administrative appeal closed. Ms. Lara Pena may appeal the substantive nature of the Commission’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
