Assistant District Attorney Plymouth County District Attorney’s Office 166 Main Street Brockton, MA 02301 Dear Attorney Palumbo: I have received the petition of Timothy Duguay, appealing the nonresponse of the Plymouth County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 28, 2023, Mr. Duguay requested the following records: [1] Number of Application For Review Of A Criminal Conviction received by the Office, Conviction Integrity Unit (CIU) since its inception; [2] Number of Application For Review Of A Criminal Conviction accepted for further investigation by the CIU since its inception; [3] Number of Application For Review Of A Criminal Conviction accepted and approved for post-conviction relief recommendation by the CIU since its inception. Claiming to not yet have received responsive records, Mr. Duguay petitioned this office and this appeal, SPR23/1956, was opened as a result. Subsequently, I learned that the Office provided a response to Mr. Duguay on August 15, 2023. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Mr. Duguay may appeal the substantive nature of the Office’s August 15th response within 90 days. See 950 C.M.R. 32.08(1).
