Wilda Records Access Officer University of Massachusetts - Amherst 341 Whitmore Administration Building 181 President’s Drive Amherst, MA 01003 Dear Ms. Wilda: I have received the petition of Colman M. Herman appealing the response of the University of Massachusetts, Amherst (UMass) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 10, 2023, Mr. Herman requested “... any and all communications related to Governor Healey’s request of UMass Amherst regarding securing stocks of mifepristone.” Prior Appeal The requested records were the subject of a prior appeal. See SPR23/1827 Determination of the Supervisor of Records (August 22, 2023). In my August 22nd determination, I ordered UMass to provide a response to Mr. Herman within ten business days. Subsequently, UMass provided a response on August 22, 2023. Unsatisfied with this response, Mr. Herman petitioned this office and this appeal, SPR23/1964, was opened as a result. It is my understanding that UMass intends on providing a further response to Mr. Herman to address his records request. Accordingly, UMass is ordered to provide Mr. Herman with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the UMass’ response within ninety days. See 950 C.M.R. 32.08(1).
