Forensic Services Senior Counsel Department of State Police Crime Laboratory 124 Acton Street Maynard, MA 01754 Dear Attorney Miller: I have received the petition of Attorney Vincent A. Bongiorni appealing the nonresponse of the Department of State Police Crime Laboratory (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 30, 2023, Attorney Bongiorni requested the following records concerning the arrest of a named individual: [1] All documents, including but not limited to reports, notes, memoranda, and communications; [2] Communications with the District Attorney’s Office and other prosecuting or law enforcement agencies and representatives thereof; [3] Communications, memoranda, notes, records and reports with or from hospitals, emergency medical services, or medical professionals; [4] Notes, reports, memoranda, video or audio recordings, transcripts, regarding witness or victim interviews; [5] All documents, including but not limited to reports, notes, memoranda, tips, complaints, and communications, search warrants, arrest warrants, and administrative subpoenas; [6] All physical, forensic, and other evidence; [7] Results, notes, reports, memoranda, communications, and/or receipts concerning forensic testing and physical evidence, photographs; [8] Subpoenas, summons, and other communications with witnesses, suspects, and potential witnesses. Claiming to not yet have received responsive records, Attorney Bongiorni petitioned this office and this appeal, SPR23/2024, was opened as a result. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Attorney Bongiorni may appeal the substantive nature of the Department’s August 28th response within ninety (90) days. See 950 C.M.R. 32.08(1).
