Bongiorni appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 30, 2023, Attorney Bongiorni requested the following records regarding the arrest of an identified individual: [1.] All documents, including but not limited to reports, notes, memoranda, and communications; [2.] Communications with the District Attorney’s Office and other prosecuting or law enforcement agencies and representatives thereof; [3.] Communications, memoranda, notes, records and reports with or from hospitals, emergency medical services, or medical professionals; [4.] Notes, reports, memoranda, video or audio recordings, transcripts, regarding witness or victim interviews; [5.] All documents, including but not limited to reports, notes, memoranda, tips, complaints, and communications, search warrants, arrest warrants, and administrative subpoenas; [6.] All physical, forensic, and other evidence; including any post mortem toxicology reports; [7.] Results, notes, reports, memoranda, communications, and/or receipts concerning forensic testing and physical evidence, photographs; and, [8.] Subpoenas, summons, and other communications with witnesses, suspects, and potential witnesses. Claiming to not yet have received responsive records, Attorney Bongiorni petitioned this office and this appeal, SPR23/2025, was opened as a result. Accordingly, the Department is ordered to provide Attorney Bongiorni with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. Attorney Bongiorni may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
