General Counsel Office of the Chief Medical Examiner 720 Albany Street Boston, MA 02118 Dear Attorney Hogberg: I have received the petition of Attorney Vincent A. Bongiorni appealing the nonresponse of the Office of the Chief Medical Examiner (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 30, 2023, Attorney Bongiorni requested the following records regarding the unattended death of an identified individual: [1] All documents, including but not limited to reports, notes, memoranda, and communications; [2] Communications with the District Attorney’s Office and other prosecuting or law enforcement agencies and representatives thereof; [3] Communications, memoranda, notes, records and reports with or from hospitals, emergency medical services, or medical professionals; [4] Notes, reports, memoranda, video or audio recordings, transcripts, regarding witness or victim interviews; [5] All documents, including but not limited to reports, notes, memoranda, tips, complaints, and communications, search warrants, arrest warrants, and administrative subpoenas; [6] All physical, forensic, and other evidence; including any post mortem toxicology reports [7] Results, notes, reports, memoranda, communications, and/or receipts concerning forensic testing and physical evidence, photographs; and, [8] Subpoenas, summons, and other communications with witnesses, suspects, and potential witnesses. Claiming to not yet have received responsive records, Attorney Bongiorni petitioned this office and this appeal, SPR23/2026, was opened as a result. SPR23/2026 Page 2 September 7, 2023 Subsequently, I learned that the Office provided Attorney Bongiorni with a response dated August 7, 2023. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed.
