Porter Records Access Officer Holyoke Police Department 138 Appleton Street Holyoke, MA 01040-5706 Dear Officer Porter: I have received the petition of Attorney Vincent A. Bongiorni appealing the nonresponse of the Holyoke Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 30, 2023, Attorney Bongiorni requested the following records regarding the arrest of an identified individual: [1.] All documents, including but not limited to reports, notes, memoranda, and communications [2.] Communications with the District Attorney’s Office and other prosecuting or law enforcement agencies and representatives thereof [3.] Communications, memoranda, notes, records and reports with or from hospitals, emergency medical services, or medical professionals [4.] Notes, reports, memoranda, video or audio records, transcripts, regarding witness or victim interviews [5.] All documents, including but not limited to reports, notes, memoranda, tips, complaints, and communications, search warrants, arrest warrants, and administrative subpoenas [6.] All physical, forensic, and other evidence [7.] Results, notes, reports, memoranda, communications, and/or receipts concerning forensic testing and physical evidence, photographs [8.] Subpoenas, summons, and other communications with witnesses, suspects, and potential witnesses[.] Claiming to not yet have received responsive records, Attorney Bongiorni petitioned this office and this appeal, SPR23/2028, was opened as a result. Accordingly, the Department is ordered to provide Attorney Bongiorni with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
