Assistant District Attorney Records Access Officer Worcester County District Attorney’s Office 225 Main Street, G-301 Worcester, MA 01608 Dear Attorney Relation: I have received the petition of Taylor S. Lavallee, Esq. appealing the nonresponse of the Worcester County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 2, 2023, Attorney Lavallee requested the following records pertaining to a “wrongful death” in Templeton, Massachusetts: [1.] All investigation reports concerning the motor vehicle accident involving the deaths of [two identified individuals], on or about [an identified date] 2022… [2.] All witness interviews concerning the motor vehicle accident involving the deaths of [two identified individuals], on or about [an identified date] 2022… [3.] All photographs taken as part of the investigation into the motor vehicle accident involving the deaths of [two identified individuals], on or about [an identified date] 2022… [4.] A copy of the full accident reconstruction by the Massachusetts State Police Department, concerning the deaths of [two identified individuals], on or about [an identified date] ... 2022 and; [5]. A copy of the autopsy/medical examiner’s reports, including photographs, toxicology reports, and causes of death reports, concerning the deaths of [two identified individuals], on or about [an identified date] 2022. Claiming to not yet have received a response, Attorney Lavallee petitioned this office and this appeal, SPR23/2029, was opened as a result. Subsequently, I learned the Office provided a response to Attorney Lavallee on August 29, 2023. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed.
