The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 12, 2023 SPR23/2055 Jacqueline Cook Keeper of Records Lowell Police Department 50 Arcand Drive Lowell, MA 01852 Dear Ms. Cook: I have received the petition of Hector Montalvo appealing the nonresponse of the Lowell Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 1, 2023, Mr. Montalvo requested the following records pertaining to Department employees: [1.] …the full name of all public servants working in the public records division…. [2.] …full name of short woman in that department on [an identified day]…. [3.] …all salaries of each of those public servants working in the records department…. [4.] …copy of job description of all public records employees handling customers [sic] request[s]…. [5.] ... copies of policies employees must follow when dealing with members of the public [6.] …name, badge number of the officer in charge for [an identified date] day shift…. [7.] …police policies on when it’s ok to refuse service to a member of the public…. [8.] …policy or memos to each employee regarding…recording public servant’s [sic] while performing their duties while at work or while in a public building. Claiming to not yet have received a response, Mr. Montalvo petitioned this office and this appeal, SPR23/2055, was opened as a result. Subsequently, I learned the Department provided a response to Mr. Montalvo on September 7, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Montalvo may appeal the substantive nature of the Department’s response within 90 days. See 950 C.M.R. 32.08(1).
