Assistant District Attorney Plymouth County District Attorney’s Office 166 Main Street Brockton, MA 01970 Dear Attorney Polumbo: I have received the petition of Justice Ainooson appealing the nonresponse of the Plymouth County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 9, 2023, Mr. Ainoonson requested “...an itemized list of all documents, materials, recordings, etc. that are in the file boxes.” Claiming to not yet have received responsive records, Mr. Ainoonson petitioned this office and this appeal, SPR23/2069, was opened as a result. Subsequently, I learned that the Office provided a response to Mr. Ainoonson on August 30, 2023. Where this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed. Mr. Ainoonson may appeal the substantive nature of the Office’s response within 90 days. See 950 C.M.R. 32.08(1).
