See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 12, 2023, Mr. McPherson requested: Any written correspondence and/or electronic documentation (to include but not limited to email, text messages, notes, journals, inter office memos, etc.) from any town employee, board or committee member that relates to [an identified address] and/or the town storm water system and/or discharge pipe from the home, or any communication identifying [an identified address] and/or the residents of [an identified address]. On May 18, 2023, Mr. McPherson stated, “[p]lease use the following date: June 30, 2022 to the present.” On May 31, 2023, the Town responded and provided a fee estimate. On June 4, 2023, Mr. McPherson stated, “[p]lease narrow the search to include [three identified individuals].” On June 5, 2023, the Town responded and provided a revised fee estimate. On June 6, 2023, the Town provided another response with another revised fee estimate. On June 29, 2023, the Town provided responsive records. Unsatisfied with the Town’s response, Mr. McPherson petitioned this office and this appeal, SPR23/2077, was opened as a result. Subsequently, I learned that the Town provided a further response dated September 12, 2023 to Mr. McPherson. Where this appeal was opened as a result of the Town’s June 6th and June 29th responses, I will now consider this administrative appeal closed. Mr. McPherson may appeal the substantive nature of the Town’s September 12th response within ninety (90) days. See 950 C.M.R. 32.08(1).
