See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 26, 2023, Mr. Herman requested “…copies of any and all communications involving the Paragon Carousel and/or the Friends of the Paragon Carousel for the period January 1, 2022 to the present.” Previous Appeal This request was the subject of a previous appeal. See SPR23/1033 Determination of the Supervisor of Records (May 26, 2023). In my May 26th determination, I ordered the Department to provide Mr. Herman with a response to his request. On August 25, 2023, the Department responded. Unsatisfied with the Department’s response, Mr. Herman petitioned this office and this appeal, SPR23/2092, was opened as a result. Subsequently, I learned that the Department provided a further response dated September 11, 2023 to Mr. Herman. Where this appeal was opened as a result of the Department’s August 25th response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Department’s September 11th response within ninety (90) days. See 950 C.M.R. 32.08(1).
