Deputy General Counsel Executive Office of Energy and Environmental Affairs 100 Cambridge Street, Suite 900 Boston, MA 02114 Dear Attorney Doherty: I have received the petition of Allan Ihrer appealing the nonresponse of the Executive Office of Energy and Environmental Affairs (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 14, 2023, Mr. Ihrer requested “[e]mails, meeting minutes, memos, and other documents related to the proposed Arborway bus facility at Forest Hills transmitted between any EOEEA representative and any MBTA representative ... [for] Jan. 10, 2022, through June 20, 2023.” Claiming to not yet have received responsive records, Mr. Ihrer petitioned this office and this appeal, SPR23/2104, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Mr. Ihrer with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Ihrer may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
