The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 18, 2023 SPR23/2113 Jeanmarie Tarara Town Clerk Town of Holbrook 50 North Franklin Street Holbrook, MA 02343 Dear Ms. Tarara: I have received the petition of Patricia Greely appealing the response of the Town of Holbrook (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 12, 2023, Ms. Greely requested, “[t]he amounts the Town has paid for any and all types of insurance, to [named individuals], and Holbrook Insurance Center, Inc. in the past two years.” The Town responded on January 18, 2023. Unsatisfied with the Town’s response, Ms. Greely petitioned this office and this appeal, SPR23/2113, was opened as a result. The Public Records Regulations, which govern the procedural aspects of all appeals, require that an appeal to this office be filed within ninety calendar days of the date of the request letter, or within ninety calendar days of the date of a written response from the record custodian. See 950 C.M.R. 32.08(1)(d); 950 C.M.R. 32.08(1)(e). Ms. Greely’s September 5, 2023 appeal of the Town’s January 18, 2022 response exceeds the ninety day limit. Ms. Greely may make a new request to the Town for the same information. The Town would then have ten business days in which to respond to the new request. G. L. c. 66, § l0(a)- (b). If the Town denies the request or fails to respond within ten business days, Ms. Greely may appeal to this office within the above timeframe. At that time this office will review the matter.
