See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 19, 2023, Mr. Bradley requested the following records: [1.] A copy of any and all records that identifies evidence submission number 9-1, including, but not limited to any scientific testing, and conclusions, and reports and documents detailing it’s collection, and preservation, and evidence submission form. [2.] … a copy of any and all records detailing what [an identified individual] ‘found’ during the inventory search of CSSS Boston, including but not limited to sent or received emails; text messages from assigned government phones; logs; indices related to the inventory search. [3.] … a copy of all records detailing [an internal audit dated September 21, 2021] including but not limited to sent or received emails; text messages from assigned government phones; the audit report, investigation, findings, and conclusions. [4.] A copy of [a] Corrective & Preventive action reports; [b] Contamination logs; [c] Testimony reviews, including but not limited to forms; [d] Management reports; [e] Internal and external audits, including but not limited to any reports, emails whether sent or received, findings, and conclusions. [6.] … a copy of (a) Examination notes, photographs, and swabb worksheet related to MSPCL Evidence submission item 12-1 et al., including, but not limited to the crime scene investigation log sheet. [7.] … a copy of all records detailing the technical and administrative review by [two identified individuals], including, but not limited to any sent or received emails, assigned government phone text messages, communications, findings, conclusions, corrective actions. [8.] … a copy of the January 28, 2013 gunshot residue spectrometer mapper relating to MSPCL Evidence Submission item number 1-5 et seq., this request includes that you disclose the negative and positive controls for the January 28, 2013 gunshot residue spectrometer mapper for item number 1-5 et seq. [9.] … a copy of [identified individuals] notepads … including but not limited to a copy of each page of their notepads; and … how many investigative note pads are in its possession, exist, was preserved, did exist, lost, or was destroyed. [10.] … any and all copies of the Crime Scene Service Secetion [sic] reports … [11.] … a copy of the MSP and MSPCL 2012 and 2014 internal and external audit records related to [two identified cases]. Previous Appeal This request was the subject of a previous appeal. See SPR23/1935 Determination of the Supervisor of Records (August 25, 2023). In my August 25th determination, I closed the appeal when I learned that the Office provided Mr. Bradley with a timely written response dated August 11, 2023. Unsatisfied with the Office’s August 11th response, Mr. Bradley petitioned this office and this appeal, SPR23/2130, was opened as a result. Subsequently, I learned that the Office intends to provide a further response to Mr. Bradley. Accordingly, the Office is ordered to provide Mr. Bradley with said response, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
