See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 24, 2023, Mr. Tobin requested the following records: [1.] Principal ... emails that involve any of the following key words: advocate, child find, special education[;] [2.] All materials provided to staff for orientation and professional development[.] Claiming to not yet have received responsive records, Mr. Tobin petitioned this office and this appeal, SPR23/2162, was opened as a result. Subsequently, I learned that the District provided a response to Mr. Tobin on September 13, 2023. Where this appeal was opened as a result of the District’s lack of a written response, I will now consider this administrative appeal closed. Mr. Tobin may appeal the substantive nature of the District’s September 12th response within ninety (90) days. See 950 C.M.R. 32.08(1).
