Denker, Esq., of Meehan, Boyle Black, & Bogdanow PC, appealing the response of the Department of Public Health (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 27, 2023, Lily O’Connor, of Meehan, Boyle Black, & Bogdanow PC., requested the following records: [1] [A]ny and all records relating to monkeypox at the Chatham Bars Inn including but not limited to the spa at the Chatham Bars Inn located at 297 Shore Road, Chatham, Massachusetts 02633, and [2] [A]ny and all records relating to monkeypox and XXXX including but not limited to tracking and tracing records. Subsequently, Attorney Denker modified the request which reduced the scope of time for requested records and requested only responsive documents held in the Massachusetts Virtual Epidemiologic Network (MAVEN). The Department responded on June 29, 2023. Unsatisfied with the Department’s response, Attorney Denker petitioned this office and this appeal, SPR23/2198, was opened as a result. It is my understanding that the Department intends on providing a further response to Attorney Denker. Accordingly, the Department is ordered to provide Attorney Denker with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
