The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 22, 2023 SPR23/2199 Kerri Johnson Records Officer Massachusetts Peace Officer Standards and Training Commission 100 Cambridge Street Boston, MA 02114 Dear Ms. Johnson: I have received the petition of Jennifer DiCarlo appealing the nonresponse of the Massachusetts Peace Officer Standards and Training Commission (POST) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 30, 2023, Ms. DiCarlo requested “... the letter dated July 17, 2023 sent from POST to the Supervisor of Public Records, indicating that the records that were provided to POST by all Massachusetts law enforcement agencies as required…are not related to [identified litigations].” Claiming to not yet have received responsive records, Ms. DiCarlo petitioned this office and this appeal, SPR23/2199, was opened as a result. Subsequently, I learned that the POST provided Ms. DiCarlo with a response dated September 15, 2023. Where this appeal was opened as a result of the POST’s lack of a written response, I will now consider this administrative appeal closed. Ms. DiCarlo may appeal the substantive nature of the POST’s September 15th response within ninety (90) days. See 950 C.M.R. 32.08(1).
