Assistant City Solicitor City of Newton 1000 Commonwealth Avenue Newton Centre, MA 02459 Dear Attorney Zawada: On September 19, 2023, this office received your petition on behalf of the City of Newton (City) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, I understand that the City furnished a copy of this petition to the requestor. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On June 25, 2023 Debra Waller requested: For the period of 1/1/19 through 12/31/20, the following information: [1.] ... All written work sent from [a specified company] to the City of Newton [including] ... Excel workbooks, analysis results, drawings, PowerPoint slides, and any written reports. [2.] ... All billing invoices sent from [the company] to the City of Newton, detailing charges for work done. [3.] ... All funds sent from the City of Newton to [the company.] This request was the subject of a previous appeal. See SPR23/1924 Determination of the Supervisor of Records (September 5, 2023). In my September 5th determination, I ordered the City to revise its fee estimate or provide further explanation regarding the assessed fees. Subsequently, the City petitioned this office for permission to charge for time spent segregating or redacting records. Subsequent to the opening of this petition, in an email to this office on September 20, 2023, the City states “that Ms. Waller paid the cost estimate in this matter.” In light of the above, I find it is unnecessary to opine on the City’s petition for permission to charge for time spent segregating or redacting responsive records.
