The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records September 28, 2023 SPR23/2237 Kristin Burgess Chief of Police Shutesbury Police Department 1 Cooleyville Road Shutesbury, MA 01072 Dear Chief Burgess: I have received the petition of Michael Vinskey appealing the response of the Shutesbury Police Department (Department) to his request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 18, 2023, Mr. Vinskey requested “Shutesbury Police Department body camera (with audio) recording of any interactions Officers . . . had involving [named person] during a traffic accident in the vicinity of . . . West Pelham Road between 1300 and 1530 hours on 30 August 2022.” On September 19, 2023, the Department responded and indicated that it was withholding responsive records pursuant to Exemptions (a) and (c) of the Public Records Law. G. L. c. 4, § 7(26)(a), (c). Unsatisfied with the Department’s response, Mr. Vinskey petitioned this office and this appeal, SPR23/2237, was opened as a result. It is my understanding that the Department intends on providing a subsequent response to Mr. Vinskey. Accordingly, the Department is ordered to provide Mr. Vinksey with said response, in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Vinksey may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
