Deputy City Solicitor City of Somerville 93 Highland Avenue Somerville, MA 02143 Dear Attorney Shapiro: I have received the petition of Chris Dwan appealing the response of the City of Somerville (City) to a request for public records. See G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On August 1, 2023, Mr. Dwan requested “... documents related to the city’s now- defunct lawsuit against Newport Construction and Northern Tree Service from the time that it was filed (November 2017) to the present.” Prior Appeal This request was the subject of a prior appeal. See SPR23/2167 Determination of the Supervisor of Records (September 21, 2023). In my September 21st determination, I closed the appeal after the City provided Mr. Dwan with a supplemental response on September 13, 2023. Unsatisfied with the response, Mr. Dwan petitioned this office and this appeal, SPR23/2260, was opened as a result. It is my understanding that the City intends on providing a further response to Mr. Dwan. Accordingly, the City is ordered to provide Mr. Dwan with said response in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Dwan may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
