Records Access Officer Office of the General Counsel Massachusetts Department of Transportation 10 Park Plaza, Suite 3910 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Attorney Joan Kennedy, of the Suffolk County Sheriff’s Department, appealing the nonresponse of the Department of Transportation - Registry of Motor Vehicles (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 21, 2023, Attorney Kennedy requested: [a] copy of any and all advertising contracts, agreements, invitations for bid (IFB) and/or requests for responses (RFR) that were entered into and/or awarded by the Massachusetts Registry of Motor Vehicles (RMV) and/or the Massachusetts Department of Transportation (DOT) concerning the vendor(s) chosen by the RMV and/or DOT between Jan. 1, 2009 and July 1, 2023 to place advertisements or other commercial materials on the electronic bulletin boards and/or electronic informational TV screens that are viewed by the general public when on the premises at [identified locations]. Claiming to not yet have received responsive records, Attorney Kennedy petitioned this office and this appeal, SPR23/2264, was opened as a result. Subsequently, I learned that the Department provided Attorney Kennedy with a response dated September 8, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Attorney Kennedy may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
