See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 15, 2023, Mr. Wood requested the following records: [1] List of all current permanent or long term substitute educators and their current license status; [2] Current Employment Agreements with permanent or long term substitute educators; and, [3] Previous Employment Agreements or Contracts with current permanent or long term substitute educators from calendar year 2022. In a September 22, 2023 response, the School provided Mr. Wood with records responsive to Item 1. The School also denied Mr. Wood access to records responsive to Items 2 and 3, asserting, “[t]hese records are exempt from disclosure pursuant to statute [G. L. c. 149, § 52C].” Unsatisfied with the School’s response, Mr. Wood petitioned the Supervisor of Records, and this appeal, SPR23/2274, was opened as a result. Based on an October 5, 2023 telephone conversation between a member of the School Superintendent’s office and an attorney in the Public Records Division, it is my understanding that the School intends to provide a further response to Mr. Wood. Conclusion Accordingly, the School is ordered to provide Mr. Wood with a response to his request in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office.
