Spofford Town Clerk Town of Townsend 272 Main Street Townsend, MA 01469 Dear Ms. Spofford: I have received the petition of Cindy King appealing the nonresponse of the Town of Townsend (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 6, 2023, Ms. King requested the following records: [1.] ... unredacted copies of each of the referenced emails or other written correspondence, including via social media accounts owned or managed by members on topic received by each member of the BOS and TA [regarding] Board of Health (BOH) meeting on August 9, 2023. [2.] BOS Executive Session on August 29, 2023 - ... a copy of any audio or video recordings from that meeting as well as any draft meeting minutes and any documents provided during the meeting. Claiming to not yet have received responsive records, Ms. King petitioned this office and this appeal, SPR23/2306, was opened as a result. Subsequently, I learned that the Town provided Ms. King with a response dated September 27, 2023. Where this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Ms. King may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
