Deputy General Counsel Department of Early Education and Care 100 Hancock Street, 4th Floor Quincy, MA 02171 Dear Attorney Orthman: I have received the petition of Jennifer Morse appealing the response of the Department of Early Education and Care (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 18, 2023, Ms. Morse requested, “…any and all documents and records related to the investigation that was conducted following a report I . . . submitted on March 13, 2023” regarding Ms. Morse’s son. The Department provided a response on August 25, 2023 and August 26, 2023. Unsatisfied with the responses, Ms. Morse petitioned this office and this appeal, SPR23/2312, was opened as a result. It is my understanding that the Department intends on providing a further response to Ms. Morse. Accordingly, the Department is ordered to provide Ms. Morse with said response in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Morse may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
