See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 5, 2023, Mr. Gibson requested the following records: 1. All documentation of DOC purchases for green t shirts[.] 2. All documentation from DOC facility Gardner regarding transgender/GNC inmates being issued green t shirts[.] 3. All documentation regarding why transgender/GNC inmates are issued green t shirts at DOC facility Gardner[.] 4. All documentation stating how many inmates at DOC facility Gardner were issued green t shirts in following years 2019, 2020, 2021, 2022, 2023[.] Claiming to not yet have received a response, Mr. Gibson petitioned this office and this appeal, SPR23/2322, was opened as a result. Subsequently, I learned the Department provided a response to Mr. Gibson on September 20, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Gibson may appeal the substantive nature of the Department’s response within 90 days. See 950 C.M.R. 32.08(1).
