Harris, of The Law Offices of Jeffrey G. Harris, appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 18, 2023, Attorney Harris requested “…records relating to the investigation of an incident that occurred on November 2, 1991 at [an identified location] resulting in the murder of [an identified individual]…includ[ing] but not limited to:” [1.] Any and all police reports, evidence inventories, and photographs concerning the investigation; [2.] Any reports concerning [an identified individual] in connection with this investigation; [3.] …any and all identification training manuals, policies and procedures that were in effect at the Department at the time of the investigation; [4.] …any and all photo arrays used by the Department in the course of their investigation of this case; [5.] Any and all audio or video recordings of defendant or witness statements obtained in the course of this investigation; [6.] Any and all reports, records, or notes not reduced to writing that contain witness statements related to the Department investigation of this incident. Claiming to not yet have received responsive records, Attorney Harris petitioned this office and this appeal, SPR23/2352, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response.
