Harris, of The Law Offices of Jeffrey G. Harris, appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 18, 2023, Attorney Harris requested “…any and all records relating to the investigation of an incident that occurred on January 18, 1969 at [an identified location] that resulted in the murder of [an identified individual]…includ[ing] but not limited to:” [1.] Any and all police reports, evidence, inventories, and photographs concerning the investigation into this incident; [2.] Any reports concerning [an identified individual] in connection with this investigation; [3.] Any and all audio or video recordings of witness statements obtained in the course of this investigation; [4.] Any and all reports, records, or notes not reduced to writing that contain witness statements related to the Department investigation of this incident. Claiming to not yet have received responsive records, Attorney Harris petitioned this office and this appeal, SPR23/2354, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney Harris with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Harris may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
