Harris, Esq. appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 18, 2023, Attorney Harris requested the following records: [1.] … any and all records in any way related to the murder of [an identified individual] at [an identified address] in Boston, Massachusetts … includ[ing:] [a.] Any and all police reports, evidence inventories, and photographs concerning the investigation…. [b.] Any reports concerning [an identified individual] in connection with this investigation…. [c.] Any and all audio or video recordings of witness statements obtained in the course of this investigation…. [d.] Any and all reports, records, or notes not reduced to writing that contain witness statements related to the investigation of this incident. Claiming to not yet have received a response, Attorney Harris petitioned this office and this appeal, SPR23/2355, was opened as a result. Subsequently, I learned the Department provided a response to Attorney Harris on October 5, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
