The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 17, 2023 SPR23/2361 Kristin Burgess Chief of Police Shutesbury Police Department 1 Cooleyville Road Shutesbury, MA 01072 Dear Chief Burgess: I have received the petition of Michael Vinskey appealing the response of the Shutesbury Police Department (Department) to his request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 18, 2023, Mr. Vinskey requested “Shutesbury Police Department body camera (with audio) recording of any interactions Officers . . . had involving [a named individual] during a traffic accident in the vicinity of . . . West Pelham Road between 1300 and 1530 hours on 30 August 2022.” Prior Appeal The requested records were the subject of a prior appeal. See SPR23/2237 Determination of the Supervisor of Records (September 28, 2023). In my September 28th determination, I closed the appeal after I learned that the Department intended to provide a supplemental response. On October 3, 2023, the Department responded and indicated that it was withholding responsive records pursuant to Exemption (a) of the Public Records Law. G. L. c. 4, § 7(26)(a). Unsatisfied with the Department’s response, Mr. Vinskey petitioned this office and this appeal, SPR23/2361, was opened as a result. It is my understanding that the Department intends on providing a subsequent response to Mr. Vinskey. Accordingly, the Department is ordered to provide Mr. Vinksey with said response, in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Vinksey may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
