Anderson, Jr. appealing the nonresponse of the Old Colony Correctional Center (Center) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 10, 2023, Mr. Anderson requested the following records “concerning the suspension of AVIP [American Veterans in Prison] and the ‘Veteran Support Group’ incarnation of it:” [1.] … any inmate veterans who were consulted in regards to the modifications made to the Group Application…. [2.] … anyone familiar with Veteran Support and/or Services who was consulted for the modifications…. [3.] … names of any and all groups/organization[s] and individuals who you’ve made contact with going back to 1 January 2023 about obtaining some form of Volunteer for the AVIP Group. And … their reply/response. Claiming to not yet have received a response, Mr. Anderson petitioned this office and this appeal, SPR23/2368, was opened as a result. Subsequently, I learned that the Center intends on providing a written response to Mr. Anderson. Accordingly, the Center is ordered to provide Mr. Anderson with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Anderson may appeal the substantive nature of the Center’s response within ninety days. See 950 C.M.R. 32.08(1).
