Associate General Counsel Cannabis Control Commission 2 Washington Square Worcester, MA 01604 Dear Attorney Carter: I have received the petition of Attorney Christine Baily appealing the nonresponse of the Cannabis Control Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 20, 2023, Attorney Baily requested information on 8/29 and 9/6: [1.] The Commission’s process of pre-approving court appointees including, but not limited to, receivers. [2.] Businesses or individuals applying to be pre-approved court appointees and Commission staff acting on these applications. [3.] List(s) of pre-approved court appointees and requests for that list. [4.] Receivers or receivership. Claiming to not yet have received a response, Attorney Baily petitioned this office and this appeal, SPR23/2374, was opened as a result. Subsequently, I learned that the Commission intends on providing a written response to Attorney Baily. Accordingly, the Commission is ordered to provide Attorney Baily with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney Baily may appeal the substantive nature of the Commission’s response within ninety days. See 950 C.M.R. 32.08(1).
