Bouchard City Clerk City of Fall River One Government Center Fall River, MA 02722 Dear Ms. Bouchard: I have received the petition of C. Samuel Sutter appealing the nonresponse of City of Fall River (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 19, 2023, Mr. Sutter requested the following records pertaining to the American Rescue Plan Act (ARPA): [1.] All monies received by the City from the state and federal government as a result of the American Rescue Plan Act. This list should include the following information for each fund allocation [including] source of funds (state or federal), amount received, date of receipt, purpose or category of the funds. [2.] A detailed list of all disbursements made by the City from the American Rescue Plan Act (ARPA) funds received. This list should include the following details for each disbursement made [including] date of disbursement, recipient of funds (individuals, organizations, businesses), purpose or category of expenditure, amount disbursed to each recipient, any additional details or documentation related to the disbursements, such as contracts, agreements or reports. Claiming to not yet have received responsive records, Mr. Sutter petitioned this office and this appeal, SPR23/2400, was opened as a result. Subsequently, I learned that the City provided Mr. Sutter with a response dated July 28, 2023. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. Sutter may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
