The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 16, 2023 SPR23/2404 Allison Mondello Primary Records Access Officer Massachusetts Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Ms. Mondello: I have received the petition of Elise Lambert, of the Committee for Public Counsel Services, appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 18, 2023, Ms. Lambert requested the following records: [1.] All records containing or reflecting any training materials from the Top Gun program relating to rules of evidence. [2.] All records containing or reflecting any training materials from the Top Gun program relating to surveillance technology and video surveillance/recording procedures. [3.] All records containing or reflecting a full list of all who have participated in and/or instructed the Top Gun program since its inception. [4.] All records containing or reflecting any syllabus or schedule used or referenced during Top Gun trainings. Claiming to not yet have received responsive records, Ms. Lambert petitioned this office and this appeal, SPR23/2404, was opened as a result. Subsequently, I learned that the Department provided Ms. Lambert with a response dated October 11, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Lambert may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
