Lambert, of the Committee for Public Counsel Services, appealing the nonresponse of the Department of State Police (Department) to two requests for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 22, 2023, Ms. Lambert requested the following records: SPR23/2403 [1.] All records containing or reflecting any rules, policies, procedures, criteria, or guidance regarding Kel devices and/or software. [2.] All records containing or reflecting any training materials, recorded trainings, manuals, or handbooks regarding Kel devices and/or software. [3.] All records containing or reflecting any contracts, agreements, procurement, budgeting, or expenditures regarding Kel devices and/or software. [4.] All records containing or reflecting data storage, evidence control, device management, officer use or device logs, authorized officer user lists, or audits regarding Kel devices and/or software. [4.] All records containing or reflecting data storage, evidence control, device management, officer use or device logs, authorized officer user lists, or audits regarding Coverttrack devices and/or software. Claiming to not yet have received a response, Ms. Lambert petitioned this office and these appeals, SPR23/2403 and SPR23/2405, were opened as a result. Despite being notified of the opening of these appeals, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Ms. Lambert with a response to her requests, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
