See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 25, 2023, the requestor sought: [1.] Any and all records, whether in electronic, hard copy, or any other format, that are in the possession of the Commonwealth of Massachusetts and the Massachusetts State Police (MSP) regarding any internal affairs investigation (I.A.) reports concerning [an identified] MSP Trooper from August 22, 2023, and the time of response to this request. These records include but are not limited to written I.A. reports, memoranda, emails (and email attachments), notes, text messages, and telephone records. [2.] Any and all records, whether in electronic, hard copy, or any other format, that are in the possession of the Commonwealth of Massachusetts and the Massachusetts State Police (MSP) regarding any disciplinary records concerning [an identified] MSP Trooper from August 22, 2023, and the time of response to this request. These records include but are not limited to written disciplinary reports, memoranda, emails (and email attachments), notes, text messages, and telephone records. Claiming to not yet have received response records, the requestor petitioned this office and this appeal, SPR23/2429, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide the requestor with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
