Mahoney & Associates LLC, appealing the nonresponse of the Department of State Police (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 25, 2023, Attorney Mahoney requested: 1. [T]he full incident report for [an identified Department employee], which was reported 1/17/1997[;] 2. The nature of any criminal charges against above-mentioned officer; 3. The nature of any charges against the aforementioned officer in any on-going Internal Affairs investigations[;] 4. Materials related to any completed or pending Internal Affairs investigation involving the aforementioned officer; 5. Any and all complaints filed or received by civilians, co-workers, and / or superiors against the aforementioned officer[;] 6. The result of any completed Internal Affairs investigation into such complaints[;] 7. Any and all sanctions imposed on the aforementioned officers by the Massachusetts State Police[;] 8. Copies of all audio and / or audio visually recorded interviews conducted by Internal Affairs interviews of complaints and interviews of percipient witnesses. Claiming to not yet have received responsive records, Attorney Mahoney petitioned this office and this appeal, SPR23/2462, was opened as a result. Accordingly, the Department is ordered to provide Attorney Mahoney with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
