Mason, of The Mason Group, Inc., appealing the nonresponse of the Medway Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 2, 2023, Mr. Mason requested the following records pertaining to a motor vehicle incident on September 27, 2023 at an identified location: [1.] Dispatch logs of incident[;] [2.] 911 calls[;] [3.] Radio transmissions[;] [4.] Initial officer’s report and witness statements[;] [5.] Reconstruction report and witness statements[;] [6.] Photographs[.] Claiming to not yet have received a response, Mr. Mason petitioned this office and this appeal, SPR23/2465, was opened as a result. It is my understanding that the Department did not receive this request until October 18, 2023. Subsequently, I learned that the Department intends on providing a written response to Mr. Mason. Accordingly, the Department is ordered to provide Mr. Mason with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Mason may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
