Ida Campus 100 Carlson Avenue Newton, MA 02459 Dear Attorney Mullen: I have received the petition of Colman Herman appealing the response of the University of Massachusetts Building Authority (UMBA) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 30, 2023, Mr. Herman requested “[c]ommunications related to UMass Dartmouth recently vacating a downtown New Bedford building that once was a department store.” Prior Appeal The requested records were the subject of a prior appeal. See SPR23/2226 Determination of the Supervisor of Records (September 25, 2022). I closed SPR23/2226 after I learned that UMBA provided Mr. Herman with a response on September 21, 2023. UMBA provided further responses on October 11, 2023, October 12, 2023 and October 19, 2023. Unsatisfied with UMBA’s responses, Mr. Herman petitioned this office and this appeal, SPR23/2478, was opened as a result. Subsequently, I learned that UMBA provided a further response to Mr. Herman on November 1, 2023. Where this appeal was opened as a result of UMBA’s September 21st, October 11th, October 12th and October 19th responses, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of UMBA’s November 1st response within ninety (90) days. See 950 C.M.R. 32.08(1).
