Suffolk County District Attorney’s Office Records Access Officer One Bulfinch Place Boston, MA 02114 Dear Attorney Doherty: I have received the petition of Timothy Duguay appealing the response of the Suffolk County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 3, 2023, Mr. Duguay requested the following: 1. Number of Applications for Review of Criminal Conviction received to date by the Integrity Review Bureau since its inception; 2. Number of Applications for Review of Criminal Conviction to date that have been approved for full investigation by the Integrity Review Bureau since its inception; 3. Number of Applications for Review of Criminal Conviction received to date that have been approved for post-conviction relief by the Integrity Review Bureau since its inception. On October 10, 2023, the Office responded and indicated that it was withholding responsive records pursuant to Exemption (a) of the Public Records Law. G. L. c. 4, § 7(26)(a). Unsatisfied with the Office’s response, Mr. Duguay petitioned this office and this appeal, SPR23/2492, was opened as a result. Subsequently, I learned that the Office responded to Mr. Duguay’s request with a further response on October 26, 2023. Where this appeal was opened as a result of the Office’s October 10th response, I will now consider this administrative appeal closed. Mr. Duguay may appeal the substantive nature of the Office’s October 26th response within ninety days. See 950 C.M.R. 32.08(1).
