Henry appealing the nonresponse of the Falmouth Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 28, 2023, Attorney Henry requested: [1.] Any and all procedures, policies, guidelines, protocols, and/or standards practiced by the [Department] during the time period of November 6, 2020 – November 6, 2022 relating in any way to the usage of tasers including any subsequent follow up care for suspects of whom tasers are discharged upon; [2.] Any and all records related to the documentation of the use and/or discharge of tasers by any Falmouth Police Department employee during the time period of November 6, 2020-November 6, 2022. Claiming to not yet have received responsive records, Attorney Henry petitioned this office and this appeal, SPR23/2495, was opened as a result. Subsequently, I learned that the Department provided Attorney Henry with a response on October 23, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Attorney Henry may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
