See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 24, 2023, Mr. Gibson requested the following records: [1.] All documentation stating purpose of DOC purchases for green t-shirts[;] [2.] All documentation stating how many green t-shirts were sent to the following DOC facilities, Norfolk, OCCC, Shirley Medium, SBCC[;] [3.] All documentation stating inmates can purchase green t-shirts[;] [4.] All documentation stating how green t-shirts are used[;] [5.] All documentation stating how inmates can obtain green t-shirts[.] Claiming to not yet have received responsive records, Mr. Gibson petitioned this office and this appeal, SPR23/2496, was opened as a result. Subsequently, I learned that the Department provided a response to Mr. Gibson on October 19, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Gibson may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
