Bolger Administrative Assistant Foxborough Police Department 8 Chestnut Street Foxborough, MA 02035 Dear Mr. Bolger: I have received the petition of Nikkilynn Mazenkas-Tracey appealing the nonresponse of the Foxborough Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 5, 2023, Ms. Mazenkas-Tracey requested “... all report, notes, calls and anything that is considered public record related to the incident that happened on Sunday 09/03/2023.” Claiming to not yet have received a response, Ms. Mazenkas-Tracey petitioned this office and this appeal, SPR23/2512, was opened as a result. Subsequently, I learned that the Department intends on providing a written response to Ms. Mazenkas-Tracey. Accordingly, the Department is ordered to provide Ms. Mazenkas-Tracey with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. Mazenkas- Tracey may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
