Assistant General Counsel Department of Mental Health 25 Staniford Street Boston, MA 02114 Dear Attorney Olotu: I have received the petition of David Fox appealing the nonresponse of the Department of Mental Health (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 15, 2023, Mr. Fox requested “…a copy of all snow plowing/ shoveling/removal contracts for [an identified location] in Brockton MA.” Claiming to not yet have received responsive records, Mr. Fox petitioned this office and this appeal, SPR23/2516, was opened as a result. It is my understanding that the Department did not receive Mr. Fox’s request until the appeal acknowledgment was sent out by this office. Subsequently, I learned that the Department provided Mr. Fox with a response dated October 30, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Fox may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
