Assistant General Counsel Suffolk County Sheriff’s Department 200 Nashua Street Boston, MA 02114 Dear Attorney Garland: I have received the petition of Colman Herman appealing the nonresponse of the Suffolk County Sheriff’s Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 29, 2023, Mr. Herman requested “[r]ecords of all the expenses that any and all Suffolk County deputy sheriffs have incurred in their capacity as deputy sheriffs for the period October 1, 2022 to the present.” Claiming to not yet have received responsive records, Mr. Herman petitioned this office and this appeal, SPR23/2546, was opened as a result. Subsequently, I learned that the Department provided Mr. Herman with a response on October 30, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
