Records Access Officer Department of Conservation and Recreation 251 Causeway Street, 9th Floor Boston, MA 02114 Dear Attorney Tencellent: I have received the petition of Ian Hunt-Isaak appealing the nonresponse of the Department of Conservation and Recreation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 1, 2023, Mr. Hunt-Isaak requested the following records: [1.] All documents (including emails, texts, and any other communications) concerning the progression of the Memorial Drive Greenway Improvements, Phase III project … including … [a.] Documents and communications that explain the gap in public process from 2019 to the June 30th 2022 public meeting…. [b.] Documents and communications discussing the reduction in project scope that occurred between 2019 and 2022…. [c.] Documents and communications occurring after the June 30th 2022 meeting. Claiming to not yet have received a response, Mr. Hunt-Isaak petitioned this office and this appeal, SPR23/2575, was opened as a result. Subsequently, I learned that the Department intends on providing a written response to Mr. Hunt-Isaak. Accordingly, the Department is ordered to provide Mr. Hunt-Isaak with a response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Hunt-Isaak may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
