See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 2, 2023, Attorney daMota requested “…all records of reports related to investigations involving the ... [identified] officers [and] includes:” [1.] All civilian complaints against these officers, including reports related to investigations involving this officer for any use of force. [2.] All internal investigations and disciplinary history relating to above listed officers. [3.] All documents supporting or relating to such investigations including the outcome. Claiming to not yet have received responsive records, Attorney daMota petitioned this office and this appeal, SPR23/2579, was opened as a result. Subsequently, I learned that the Department provided Attorney daMota with a response dated October 31, 2023. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Attorney daMota may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
